i was saddened by her story and pitied her and was so enraged with this daniel smith guy months and moths past but

now i think nicole’s a materialistic, stupid, pathetic girl who just thirsts for attention (wow, combs her hair while walking past cameras.woot woot cameras everywhere, talk of the town/country).

binale-wala niya ang efforts ng mga tumulong at tumutulong sa kaniya. what about the medical findings, yung alcohol level, yung bruises sa internal genitalia niya..and all that stuff..wasted by backing away from the case. naisip ko tuloy:

baka wala siyang bilib sa sistema dito sa Pilipinas, walang bilib sa mga Pilipinong experto na naglaan ng oras at panahon para matutukang maige yung kaso niya.

naisip niya siguro na di kapani-paniwala ang mga findings nila (kasi nababayaran din sila tulad ng halos lahat ng ahensya ng gobyerno), ganun ba yun?

o baka naman habol lang talaga niya ang ‘american dream’.

dumagdag pa sa kakairitahan mo dito kay nicole ay pinapakita niya kung pa’no siya mag-isip:

bara-barang nagdedesisyon sa buhay niya. bara-barang pumunta sa subic..tumanggi ka man ng dalawang beses, nicole, sa dulo din naman:

pumunta ka pa din.
yun na yun.

yung pagtanggi mo ng dalawang beses nung umpisa walang saysay yun kasi kung matino ka talaga:

una, hindi ka dapat pumunta–> anong ‘break’ ang sinasabi nila? ‘break’ saan?(napaka-bait naman ng banyagang ito para maging concern na hirap na hirap ka na sa trabaho. di ba niya naisip na source ito ng kabuhayan mo at tama lang na andun ka? the fact na nambulabog pa ng ibang tao para lang makasama ang mga kanong yun, sounds really pathetic.were you that burdened with the business that puts food in your mouth?)

pangalawa–>nag-sama ka dapat ng lalaking kaibigan mo o kapatid.(tandaan, hindi ka taga-subic, that fact in itself poses potential harm na..what more yung makikipagkita ka sa grupo ng mga kano?)

pangatlo–>di ka magpapakalsing.(ang tawag sa ginawa mo: nagpakawala ka. drinking too many liquor will inevitably make you drunk, ofcourse.how stupid of you to easily trust yourself with these guys.you barely know them.they barely know you. they pretty much don’t care about you and what happens to you.they’ve got nothing to do with you except ofcourse..what you previously accused them of doing that’s ‘against your will’)

the most irritating of all is the fact that she’s going to the states. i mean, seriously??? even my ten year old sister feels something is wrong with the way she thinks, reflecting the majority of how filipinos think of what a good life is.

ang napipintong pagpunta niya sa states ay para sa ‘bagong buhay’? ha?? Bat laging ganun pag-iisp ng mga Pilipino nga pala:

ang galing galing mo nicole. good thing you cover your face everytime, you are saved from being approached by filipinos who are so angry by your stupidity.

ok na sana na tumiwalag siya e, pero ang pagpunta niya sa abroad ay nangangahulugan ng pagtakas–it gives off a notion to us audiences of this telenovela-ish story that indeed, may nangyari beyond our knowledge. nicole disappoints us. nasayang ang chance ng Philippine government na ipakita ang kahusayan nito, but this time,dun sa tamang paraan na, finally.

argh. i know that the points i have cited don’t seem to be cohesive, after all i am not a learned lawyer, doctor, wtvr..but the thing is, i am alarmed. as a youth, i am really concerned with this matter.

as well as enraged with this nicole girl.

It keeps getting clearer and clearer that both Smith and Suzette were USED? in this case because they are young and naive.

Suzette was used by Gabriela, Maza, Hontiveros, Madrigal, Salonga, anti-Americans., etc.

Smith was used by Judge Pozon and the Philippine Judiciary System.

The Philippine DOJ must investigate Suzette’s lawyer, Evalyn Ursua, and Gabriela, Bayan Muna, etc., and find out if Ursua wanted Suzette to give false testimony.

If proven guilty, Ursua and her groupies could go to jail from 6 years to 40 years.

Rape Victim Assistance and Protection Act of 1998.

Section 5. Protective Measures. – At any stage of the investigation, prosecution and trial of a complaint for rape, the police officer, the prosecutor, the court and its officers, as well as the parties to the complaint shall recognize the right to privacy of the offended party and the accused. Towards this end, the police officer, prosecutor, or the court to whom the complaint has been referred may, whenever necessary to ensure fair and impartial proceedings, and after considering all circumstances for the best interest of the parties, order a closed-door investigation, prosecution or trial and that the name and personal circumstances of the offended party and/or the accused, or any other information tending to establish their identities, and such circumstances or information on the complaint shall not be disclosed to the public.

Most disingenuously and dishonestly neither of the two Lady Lawyers bothered to mention this entirely fair and reasonable parity of rights to privacy of BOTH the “offended party” and of the “accused.”

Imagine indeed that Party A is accused of raping Party B. Until trial and appeals processes are exhausted we, the public, cannot really presume to know whether the accused is guilty or not, nor whether the accuser is telling the truth or not. Therefore it only stands to reason and the essential sense of fairness that the privacy of BOTH parties out to be kept out of the public domain.

RA 8505 explicitly demands it as the solemn duty and responsibility of “the police officer, the prosecutor, the court and its officers, as well as the parties to the complaints”.

The outrageous thing about Ursua’s and Legarda’s statements that were broadcast tonight was their accusation against the Philippine Daily Inquirer (and “anyone else who published the full real name and pictures of Nicole”) — that they had criminally violated this law, RA 8505 and three other similar laws, in their March 18 report on the recantation affidavit of Nicole. Yet is it not crystal clear that the principal obligation to maintain privacy of BOTH parties actually rests on the Courts and on the lawyers??
