From Nicole on the anniversary of the Subic rape

Isang taon na ang nakalipas mula nang ako ay ginahasa at tinapon ng mga Amerikanong sundalo sa tabi ng daan na parang baboy. Sa araw na ito noong nakaraang taon, pumunta ako sa Subic kasama ang aking mga kapatid para magbakasyon. Noon, punong-puno ako ng buhay at pag-asa sa aking kinabukasan. Noon, masaya akong nabubuhay kasama ang aking pamilya. Hindi ko akalain na ang aking pagbakasyon sa Subic ay hahantong sa isang trahedya. Sa araw na ito noong nakaraang taon, nagbago ang aking buhay.

Ngayon, matapos ang isang taon, bumalik ako sa Subic. At sa aking pagbabalik, nandito muli ang USS Essex, ang barkong sinakyan ng aking mga rapists na sina Daniel Smith, Chad Carpentier, Dominic Duplantis at Keith Silkwood. Nandito muli ang mga libu-libong Amerikanong sundalo para sa kanilang “rest and recreation.” Muli silang maghahanap ng mga babaeng biktimahin at pagsasamantalahan. Sa araw na ito ilan kaya ang mga babaeng magagahasa gaya ng nangyari sa akin noon. Ilang Nicole kaya ang itatapon ng mga sundalong Amerikano sa tabi ng daan, o iwanan na luray-luray ang kaluluwa’t katawan? Gaano katagal at kalakas na halakhak ang kanilang maririnig samantalang sila ay ginagahasa?

Hindi naging madali ang aking pagsampa ng reklamo laban sa aking mga rapists. At lalong hindi naging mabait sa akin ang sistema nang ako’y magdesisyon na ituloy ang aking kaso. Sa halip na maging kakampi ko sa aking pakikipaglaban, ang ating gobyerno ay gumawa ng mga hakbang na mas lalong nagpahirap sa aking sitwasyon. Wala ni isang pahayag ng suporta ang nanggaling sa ating babaeng Pangulo, samantalang ang Kalihim ng Department of Justice ay paulit-ulit pang pinagtanggol ang aking mga rapists.

Sa halos araw-araw na paglilitis sa Makati Regional Trial Court, aking naranasan ang reyalidad na ang biktima ng panggagahasa ay paulit-ulit pang nagagahasa sa loob at labas ng korte habang siya ay nagkakaso. Sa lahat ng panlalait at paninisi na aking naranasan sa nakaraang taon, tanging ang aking paniniwala sa katotohanan at katarungan at ang suporta ng aking pamilya at kababaihan ang nagpatatag sa akin na hindi sumuko. Ang aking pagpupursigi sa kaso ay nagpapakita ng aking paninindigan na dapat makulong sina Daniel Smith, Chad Carpentier, Keith Silkwood at Dominic Duplantis. Dapat nilang pagdusahan ang kahayupang ginawa nila sa akin. Dapat silang makulong. Dapat maging halimbawa sa buong mundo at sa mga sundalong Amerikano ang pagpaparusa sa kanila.

Sa araw na ito, ako ay sumisigaw ng hustisya!

Kung gusto nya magsayaw at depende sa klase ng sayaw. Napakababaw mo talaga. Hindi ka nakakaawa. Nakakainis ka, siguro, talagang naudyukan ka lang na magsampa ng kasong yan laban sa mga sundalong kano na yon, tapos lahat dinadamay mo. Sigurado, wala ka nang mabibiktima sa kanila dahil napakasinungaling mo. Mas maigi pa, kung pursigido kang lumaban ng hindi na kailangan kumuha ng simpatiya ng mga kababaihan, baka mas may maniwala pa sa iyo. Tama yung kaibigan ko, hindi ka nga dapat pag-aksayahan ng oras at panahon. Marami kami dito sa US na nakapag-asawa ng US NAVY ang hindi naniniwala sa iyo. Halos lahat kami na nakapag-asawa ng US Navy ay nanggaling sa mga bar jan sa Subic pero, hindi kami nakaranas ng sinasabi mo, dahil nakikita ng mga sundalo na kahit kami mga bar girl ay may respeto naman kami sa sarili namin, kaya nirerespeto rin nila kami.     Iyan na nga ang dahilan kaya mas kailangan ni Nicole ng suporta. Siya lang ang nagkaroon ng lakas ng loob na maghain ng kaso na rape laban sa kanila. Siguro akala nila lahat ng babaeng nire-rape nila ay tatahimik lang. Intindihin mong mabuti ang istorya ng bawat panig, para ma-appreciate mo ang kaso. Sa palagay ko ay isa kang kaibigan o may karelasyon ka sa isa sa kanila kaya mo sila ipinagtatanggol.

    Kung ikaw rin ang hurado emily o maggie o kung sino ka man, kawawa rin ang mga rape victims sa ‘yo… masyado kang bilib sa mga ‘kano bahala nang gahasain ang sinumang babae basta di ka maniniwala.

    Parang si emily at si maggie ay iisang tao lamang, pareho ang pattern ng pagsusulat paulit-ulit basta lang maiparating at maipagmalaki na ok ang kalagayan niya sa piling ng asawang amerikanong sundalo at mapanghusga/mapanglait sa ibang babaeng nagtatrabaho sa mga bars sa subic.

    Eh, hindi nga ganun ang sitwasyon ni “Nicole”. Kung di mo maintindihan ang kaibahan, kawawa ka naman.

Pareho kami nandito sa US, si maggie po ay may asawang US Marine at ako naman po ay fiancee pa lang ng isang US Navy, pero malapit na kami ikasal. Hindi kaya ka-kutsaba rin nila si Gloria kaya hindi nila magawa yun?

    Hehehe, sayang naman ang ipinaglaban ng ating mga bayani at ang ibinuwis nilang buhay makalaya lang sa kapangyarihan ng mga ganid na dayuhang kastila, hapon at kano. Sana wag na lang makialam ang mga kano sa internal sa usapin at seguridad ng ating bansa. Para wala nang kasong tulad nitong kay Nicole.     In the decades leading up to the handover of the bases, a number of incidents created a groundswell of anger among Filipinos as sometimes it seemed that US soldiers were using the locals for target practice but rarely faced justice.

    In 1964 a Filipino boy was shot in the back by a sentry at the Clark Airfield. This was followed by the killing of a Filipino fisherman by American sentries at the Subic Bay naval base.

    The shootings triggered a series of demonstrations at the bases and outside the US embassy in Manila, which tried to explain away the shooting of the boy by saying that “certain Filipinos” had tried to bomb an American school at Clark.

    In 1968 a Filipino was shot dead by an American sentry at a US base in Cavite and in 1969 a US soldier went hunting with his service pistol and shot a Filipino employed at the base. In his defense the soldier said he thought the Filipino was a wild bore.

    After a brief investigation by the US authorities it was found that there was no case to answer and a few days later the soldier was put on a military aircraft and sent back to the US.

    Under the agreement that existed then US military personnel were not subject to Philippine law for crimes committed in the country.

    Against this background — despite the historical ties between the two countries and the affinity many Filipinos feel for the US — the Subic Bay rape case has been bitterly divisive.

    Women’s groups have rallied around the woman, identified only as “Nicole,” claiming she is an innocent victim.

    Smith has never denied having sex with the woman but he and his co-accused have maintained it was consensual.

    Joseph Briceno – (I imagine that people close to the pediphile priests are not surprised at all that they were found guilty of such crimes. People in a parish are not necessarily, personally familiar with their priest. Other priests, nuns, and probably some observant parishoners are not surprised because they can look back and see the signs.)

    The scandal has grown to encompass the response of Republican congressional leaders to previous complaints about (Mark) Foley’s contacts with the pages and inconsistencies in the leaders’ public statements. (The people around him were not surprised)

    As for Daniel Smith, there are absolutely zero signs from his past. On the contrary, his character is totally opposite. He’s polite, respectful, and has a loving middle class family. He’s not making tons of money off the blind faith of religious zealots such as the televangalists. Nor is he a pedophile, or a criminal with a troubled past. He’s just a normal young man who was out to have a good time. If “Nicole” would have said no, he would have respected it.

    My only point here is that I know Dan to be respectful and kind. There are people here who personally know “Nicole” and they claim to know that she is lying. That’s it!

    So all of you blind lemmings can just keep on following “the cause” and just keep dropping off the cliff.

    As I have mentioned in previous comments, I am an American that lives in the Philippines, and I was here when the alleged rape incident first surfaced and I am still here watching the case unfold. I agree with you, the general publics mentality concerning the presumption of innocent until proven guilty is not applied to Americans/foreigners. (If you don’t agree open your eyes, it’s a fact amongst Americans/foreigners that live here, not just to these 4 Marines) I mentioned in a previous comment that I too was falsely charged with a crime in this country. I found (1st hand) how it was being an American going through the process. (Though I was not covered by the VFA) [Meaning I did not have someone looking over my shoulder to ensure I was not being ill advised], Anyway, I found the same ideology thrived, at every level I had to go through. That I was guilty just because someone pointed his or her finger at me and said I did something to him or her. It was infuriating, but you’re put in a position where there isn’t much you can do or say with out becoming disrespectful or creating real charges. Now, in order to protect my family and myself, I have a different perspective for the people here. I did not create this perspective; the people gave it to me.

    Fortunately for ALL in this case, the venue was in Manila court. I think this better than heard in Olongapo hall of Justice where the case was 1st assigned. Much better chance of Justice in Manila! Lets all hope Justice prevails!

    Here is a question to all. When you pray to whatever God, spirit, you pray to about this case, you’re praying to the almighty that knows everything, right? There are a number of parents who abuse their own children. I guess that speaks of the nature of the crime that all parents are capable of, so from now on, parents should be arrested and thrown in jail on the word of a child..forget evidence or a trial..we know they’re capable of it.     I don’t know if you read the Internet editions of the Philippine newspapers but this is the best source of information concerning the case if you are outside the Philippines because it gives you the perspective within the country. If you have not already, Goggle search for “Philippine news” and all the papers/links come up. This is where most of the articles from this site have come from but they pick and choose what to put on.

    The papers are written from with in the country so you will see that point of view. Most are in English.

    The 1st copy and past link below I received today and found it typical of the attitude in this site but the article is in a major newspaper. (The article regarding Nicole’s Christmas gift) The other links are miscellaneous copy and pastes of no particular order.

    The local TV has been quiet of the case since Nicole went to SBMA on Nov 1st to do what ever it was she was trying to do. Walking around near, but not at, the US ships is what footage I saw. (The US ships were in port then too.)

    I am happy to see you, Justice seeker, Mr. Dalid, and others through out this pro Nicole site, continue to remind readers that there are two scales when evaluating Justice. I hope all of you can maintain your patience and articulation if you choose to comment with the (what I consider) misguided people of the site, so they do not continue to mislead others.

    I really hope our lady of Justice has her blindfold on, her scale(s) balanced, and her heart in the right place when Justice is delivered on the 27th.

    In the Philippines, is it common for rapists to wear a condom and dress their victims after the fact? Why wouldn’t they just take off out of the van to their ship? Why bother to dress her at all? Or could it be that in HER haste, with the embarassment of the van stopping, the doors opening, and the lights going on, SHE had a difficult time getting herself dressed?

    Do you think the courts might contemplate these questions? Or maybe they should just say “Nicole said she was raped….hang the beasts!”

    This is a statement on the record made by a witness who was physically present in the van while this was happening. And this is a fact that could not be changed regardless of your effort to contradict this.

Pyke Torres denied subjecting him under force when Timoteo Soriano signed his first statement. Timoteo Soriano said what he was arguing was the word “gang rape”.

    Soriano executed another affidavit on Dec. 12, 2005. In that affidavit, he accused investigator Pyke Torres of punching him twice on the back to force him to admit to witnessing a gang rape. In the presence of a high ranking officer, the act of sex, whether if be consensual or rape, should have never been allowed or consented, and much worst, concealed by turning up the volume of the stereo. Philippines, being predominantly Catholic, you can expect my country to deal with the issue about sex outside marriage, much worse when sex is being done in the presence of other people around.     I read from ‘Bulatlat’ (on line edition) that there was this woman who actually witnessed this van used in the rape, going around in the vicinity there in Subic with a loud music on. The report or news was datelined Nov 2005. She said a used orange condom was actually thrown on her direction landing on her feet. Used because according to her it was sticky. The presumption made was this was another condom, meaning there was a second man that raped Nicole inside the van.

    Am not sure if this woman was allowed to testify. I was trying to read all the court summary of the proceedings, but my comp was acting up recently and i was not able to open up the earlier summaries. Can anyone on the know be kind enough to post here if she was in fact was able or allowed to testify?

[What is new to me are as follows:] The three men stand on their knees, their backs to the driver. Driver says the group did not take turns raping the victim. Driver tries to switch on the light inside the van. Carpentier stops him. Carpentier instead turns up the radio louder. The incident takes 10 to 20 minutes.

    The Starex van stops somewhere along Alava Pier and there unloads the girl. Driver says victim’s pants lowered to her knees.

    Firstly, NIcole i admire your courage and also that of your family. What you did was right – bringing them to the court. Had you been silent, who knows they can reoffend and another woman or women will suffer. Offenders like them usually repeat their crimes, sometimes many times over. Imagine how many women you will have potentially saved. The reality is that in many countries, many crimes could have been prevented had the offenders been jailed the first time they committed a crime.

    Emay: I find it difficult to accept the story made by “Olivia”, the woman who claimed a used orange condom was actually thrown on her direction landing on her left foot. According to her story, during the night of Nov. 1, 2005, she encountered the Starex van 5 times in a row, and I am assuming she was roaming around within an area of 1 Km distance by foot. It seems that encountering that Starex van 5 times during that night is hard for me to believe. Maybe that was the reason she was not selected to be a witness during the court hearing.

    Crossfire, I have not been to Subic so i do not know specific places mentioned thereabout, so you may be right. Also Nicole’s lawyer, in her good judgment, probably saw loopholes about her stories and decided not to let her be a witness.

    I have a contrary view with that of Ross Hunt. There was not too many media people covering the case, much so, writing in her favour. I mean, you google and there wasn’t even enough story you can find about this case. Also, if there are people already judging in favor of Nicole, there are also some who also are defending them, notably Fr. Reuter and one mentioned above with the name of Pastor Mel Go as mentioned by blogger TK. What could have been their basis in judging so. That they are clean-cut, soft spoken and not wild people? Are they enough basis? The witnesses of the marines are they themselves, so that is too self serving. At least, those who are finding those marines guilty have basis, the testimonies of third party witnesses.

    Another thing, the driver of the van whose original statement would have pinned those marines, recanted. Why could he possibly recant, if the police had all the equipment and procedures in place. Are the police force in the Phil not video taping the interview? If there was there could have been no claim of ‘duress’. Am no lawyer, but i watched a lot of crime scene investigations on tv. I think it does not need a lot of intelligence to determine whether they are guilty or not. The evidences speak for themselves, unless —-?????. We will see what would happen!!!

    I totally agree with you Emay about your comment that the statement made by Timoteo Soriano, Jr., the driver of the Starex van, would have pinned down the US Marines. This is the reason why I have been thinking from the start of this case why the Prosecutor side did not give Timoteo Soriano the immunity from being prosecuted. He is the key witness that might make this case easier had he been granted the immunity from prosection. His witness is so valuable that if he was able to speak up about what he had seen during that time without fear of self-incrimination, this case would have been easier.

    Granting an immunity from being prosecuted is a common practice in the US and I am citing a clear description of this as to why it is important in some cases:

    Immunity from Prosecution

    “State and federal statutes may grant witnesses immunity from prosecution for the use of their testimony in court or before a grand jury. Sometimes, the testimony of one witness is so valuable to the goals of crime prevention and justice that the promise of allowing that witness to go unpunished is a fair trade……………. Although the Fifth Amendment to the U.S. Constitution grants witnesses a privilege against self-incrimination, the U.S. Supreme Court has permitted prosecutors to overcome this privilege by granting witnesses immunity.     on the 4th it will be the promulgation, yet there are still some people who says it was a consensual sex. i know every person has the right for their own opinion, but it goes with the right information and knowledge about something before you express such comments and opinions.

    i believe that everyone who comments here read all the articles written and follows the news about the case. because if not, you won’t have the interest in writing your comments her in the first place. unless, you are tasked to spread black propagandas here.

    but, my question is, DO YOU REALLY KNOW WHAT YOU ARE TALKING ABOUT?!?

    i mean, how well do you know this case? how well do you know nicole or the US Marines? some of the comments i’ve read says they know nicole or the US marines personally, and that either the two parties cannot do such thing that they are being accused of (nicole for being accused of having consensual sex and saying she was raped after, the US marines for the rape accusations).

    either nicole or the US marines are worthy of the benefit of the doubt.

    i personally believe that nicole was raped. yes. i am a supporter of nicole myself. and i am not a member of any organizations who help her nor a member of her family or even from her circle of friends.

    for me, i do believe that.. first,anyone who risks her name and credibility for just to attain justice in spite of all bad comments and black propagandas is enough to say she is telling the truth. second, i know that every woman do not deserve to be raped. because they are also part of the society who should be treated equally and with respect. another, given that she was not raped and they really just had consensual sex, the act of dumping a woman in the gutter with pants off and condom on her pants is an embarrassment and a form of violence against women. VAW is also a public crime in case you people don’t know.

    i hope the things i wrote here gives anything that might help you people on your opinions. i do not intend to have debates or arguements with you. im just expressing what i have in mind.

    whether nicole is telling the truth or not, it’s all up to the court to rule. Unfortunately, Philippine courts have a very notorious reputation when it comes to sell-outs. Further, the executive branch can always impose its rule on the judiciary. Since this is as much as a political case as it is a criminal case, we all know what to expect.

    i feel sorry for nicole. whether she was a bar girl or otherwise, no man could just shove his penis up her and ignore her protests, in whatever form it may be.

    but i feel more sorry for my country. nicole’s case shocked the entire nation when we first heard of her case, but just a few months later, nobody gave a damn, no serious undertaking was spearheaded by both national and local governments to resolve the underlying cause of why such thing happened. same thing when the US bases were removed from the country, no american politician ever expressed concern on the pollution they wreaked. no american official ever sent help to filipino kids who were born with diseases caused by the water contamination.

    the american governtment is the worst people to ever walk this earth. i hope the american people will make the right decision come election time.

    I have two jobs that require me to be at work for almost 20 hours a day. That is the reason I now feel so restless about this case. It happened over a year ago and I never even knew about it. I just heard my brother asking my other brother to see if the verdict was in. I wondered what would interest my brothers that much since they normally don’t care for these things. Forgive me but I must say that my initial reaction was to side with the Americans. I watched the proceedings and not soon after hit cyberspace for more details. I only wish I had the details of the case so I’ll be justified in my support of Smith.

    I am well-versed in the criminal justice system, and suffice it to say, I am big on evidence. Operating on what I know and what I’ve heard, there WAS reasonable doubt in that there was conflicting testimony of whether Nicole was intoxicated beyond rational thought or self-defense; and contrary to common belief, the angle of vaginal lacerations considered to be consistent with rape do not always amount to rape. Either or both party could’ve been into BDSM for all we know and that would achieve the same effect. Whatever the case was, it still goes back to how it all played out. For every pleasure there is an accompanying responsibility. Needless to say, everyone is responsible for his actions. Nobody cares how drunk you want to be as long as you can ultimately account for your actions and be willing to suffer the consequences. And before you can even utter a syllable, this does not mean that if someone rapes you because of that, he will be let off the hook. He will still be prosecuted to the full extent of the law. All the courts in the world can sentence your rapist to 70 times 7 life sentences but in the end you will have to deal with the fact that none of it would’ve happened if you were responsible enough to stay sober if you were going out alone. If you weren’t out alone, where were all your friends? Were they as wasted as you were? Were you drugged? That wouldn’t have happened if there were somebody there to look out for you or if you yourself valued your safety enough to stay sober or to know better than keeping the company of more men than you can handle. Or more importantly, a situation that’s beyond whatever comprehension you can muster—like trying out for American Idol when you know you’re William Hung. Then again the thought probably never even occurred to you. You just wanted to have fun.

    The other comments make a LOT of sense. What do we know Subic to be? For all we know you picked that place in the hopes of hooking up with an American. If you were out with those Americans–or ANY man, for that matter–you should’ve been careful. Why do you think we teach our children to not talk to strangers? Judgment is key! If you were out alone you should know that your other foot is always in the grave. If those men passed you by in the street and grabbed you, why the hell were you walking alone at night in a place like that? Worse, why were you walking alone AND INTOXICATED at night in a place like that? You yourself said in your retrospective essay that an all-new horde of marines were there on their R&R. what do you think they’re there for, prayer? And all of you speak of justice. Fair enough. Now, I ask you, is it fair that you, Nicole, now see all these soldiers to be rapists? That is just WRONG.

    I have so much going on in my mind I don’t even know how to put it all in here. Like I said, I don’t have the details of the case. But if one takes the time to take all of this in, it all boils down to common sense. Common sense is not so common. There are people with two or three degrees and masters even, who meet their demise for a really stupid reason. I am trying so hard to be objective here but apparently, I am not succeeding at it. It’s just that if there’s one thing I cannot tolerate, it’s stupidity. By stupidity I don’t mean just the scholastic aspect. Many people have gone through life with little or no education and still lived fruitfully. It all boils down to how you use the hand you were dealt with and the lessons life teaches you along the way. If you had sound judgment nothing as mundane as the precursory events of that night would’ve ended with you being raped.

    To the hosts of this site, you should not be upset about all the negative comments you get. You did say you wanted to know what people had to say, didn’t you? So here you are. What goes on in this site has no bearing in court or on Nicole. Eleanor Roosevelt said, “Nobody can make you feel inferior without your consent.” I am someone who has been misconstrued most of my life but did I let that get to me? Hell, no! I am where I am now because I learned to use those false accusations in my favor. Those rumors were spun out of envy or whatever else their reasons were, and I couldn’t care less because ultimately, they do not define who and what I am. Talk eventually dies. How you see yourself and the way you handle yourself amidst that is what brings you over to another day. If Nicole really IS a victim, all this negativity should only make her stronger.

    I want to go on but I don’t think there’s room for that here; so allow me to enlighten you on why I’m inclined to believe the Americans.

    The Philippine culture is that of stubborn adherence to tradition despite proof of change being the better way. Add to that the penchant for ridiculous superstition and you get a country that, if at all, moves sluggishly forward. American culture on the other hand is progressive, liberal. We like to think our justice system operates like clockwork but we have to admit it is still and more often than not, a conspiracy among the elite and the people in high office. How can it not be with the judge carrying his weight around the entire case? The Americans have the jury system. I wish we had that here. Then again, if we were to have jurors deeply rooted in Philippine culture, we might as well have the plaintiff’s family and friends on the jury stand as I’m sure BIAS would saturate the courtroom. [sigh]

    Well, so much for all that. I have not even gotten into the argument of whether or not Smith was guilty of rape to begin with. I am aware that this will elicit both negative and positive responses but I am not in the least apologetic of my contention. True, my perspective is not even in the same zip code as that of Nicole and her supporters, but the reason it isn’t is that I look out for myself. When I have to make any kind of decision I look into the future and try to visualize the worst case scenario. Being only human I do not always make the right choices. But if I happen to choose against the wiser decision I take full responsibility of my actions and face the consequences head on. For the most part, however, I make sure that I don’t bring myself to situations that can only end in tragedy. We all should.

    The verdict handed down by the court toward the principal accused as guilty as charged was right according to evidence presented, as summarized in the verdict, but I’m not convinced the others co-accused are not-quilty of lesser offense of Accessories to the Crime, or Contributory to the crime. They were there, they knew what was happening, they were cheering, how could they be pronounced as the decision seemed to convey that they were just innocent bystanders? Still a partial success, but that is Justice, they can no longer be charged for the same offence, for that would amount to double jeopardy. I believe that the court decision, however, the system works is a start for a better Justice for all, no matter which one belongs in this very uneven playing field in a very Selective Judicial System that was critizised by so many before. And for Nicole, a vindication…

    I am only partially happy with the verdict and I strongly believed that SSGT Chad Carpentier should also be convicted, because, being a Senior Staff Sergeant, he has the full responsibility to control the behaviour of the US Marines under him. When Timeteo Soriano Jr. became suspicious of what was going on, SSGT Carpentier tried to conceal what was going on by turning up the volume of the stereo, and I even read that Soriano was trying to turn on the light inside the van, but Carpentier stopped him.

    The monetary penalty damages of P100,000 is just too small. I was thinking it would reach to several hundred thousand US dollars.

    Alas!Nicole is in great jubilation!At first, I don’t know how will I’m going to react yesterday after hearing the Very Intellectual Decision of the court, if I’ll get irritated or be mad or I’ll just smile..I thought t’was a already a Subic Slain Case. Of course what to expect if I watched local proceedings like this…the battle of sympathy and political interest will always win more than battle of legality.

    I don’t know how good looking and big celebrity is Nicole..but one thing I admire Nicole..and its very obvious she’s a very good actress that she even magnet the sympathy of the court.

    And for those individuals behind Nicole’s agenda…I’m so sad to you guys!you just not make our country a laughing issue but a real picture of desolation.

    this is just another example of the poreigner being always wrong even when he is being lied to or lied upon(as in this case) if this case had been heard by an impartial judge this case would not have even made it to court. the was no valid evidence of non-consnsual sex. it was all he said she said crap!!
    and circumstainial evidense at best yet very few treated it as a innocent until proven guilty, in fact just the opposite. the fact that he was not a pinoy had most people convinced he was guilty. the “he’s not one of us so he’s guilty” mentality.

    certainly creates for perverts the impression that it’s cheaper to rape someone than to buy a car.

    I still hope and pray that justice will prevail in favor of Lance Corporal Daniel Smith. I have met this guy once during my tour to the US Marine bootcamp. He was so young then and full of dreams and aspirations in life. Hope the Philippines would abide by the Visiting Forces Agreement that Smith should be in the custody US Embassy. Afterall, he had served and helped the Philippine military with pride and dignity.

    Lahat tayo ay may KARAPATAN magbigay ng opinion sa mga issues ng bansa dahil tayo ay nasa isang demokratikong gobyerno…especially sa issue na ito na talaga naman napakainit kahit na naipanalo na sa regional court…pero hindi naman siguro basehan ang karapatang ito para tayo’y mangmata ng tao…maniwala man kayo o hindi sa mga taong involve sa kaso…hindi yun dahilan para gawin ito.

    OK “Nicole” is considered as a low profile lady by some people…but still she is a human and she deserves a respect from anyone…I don’t believe sa kasabihang “respect is something you earn”…as a human it should be given automatically as part of our responsibilities.

    Hindi totoo na hindi makuha ni Nicole ang sympathy ng gobyerno dahil sa hindi sila naniniwala…kundi super busy lang talaga ang gobyerno sa ibang issue na FOR THEM ay very very important. Im not saying na hindi important ang kaso na ito kaya lang may part ng government na syang dapat mangasiwa sa mga ganitong kaso…Hindi naman obligado ang Gobeyerno na makisangkot sa case na ito kasi napakarami pang ibang kaso na kailangan din ng pansin nila mismo…kaya hindi dapat gawing batayan ang hindi pakikialam ng gobyerno para masabing hindi talaga sya narape.

    Rape is not a normal rape case na iniisip nyo…na para bang ang isang babaeng naglalakad na biglang hinatak at pinuwersa ng mga lasing sa kanto…malawak ang rape case lalo na’t pinalawak ang sakop nito ng bagong rape law…hindi basehan ang pagkatao, virginity, gender, maging ang uri ng trabaho meron ang isang rape victim…kung eto ang basehan e di sana di na lang pinatunayan na ginahasa sya…sana pintunayan na lang pala na wild sya or may mababang uri sya ng trabaho.

    Hindi naman lahat ng amerikano ay magkakaperaho same with Filipinos…kaya hindi basehan na may amerikanong fiancé asawa or kaibigan ka para sabihin na di ka naniniwala dahil nga may asawa kang kano or vice versa…iba ang civilian sa army o government officials…at syempre depende parin sa tao ang kabutihan…at wala yun sa nationality.

    Wala akong kinakampihan sa kanila…Dahil una di ko sila pare-parehong kakilala…Pangalawa wala ako sa trial court para masaksihan ang mga ebidensyang prinesent ng mga taong involve sa kaso…at higit sa lahat wala ako sa pinangyarihan…nung una ngang lumabas ito wala akong pakialam…pero nung mabasa ko na ang mga komento at opinions (online and newpapers) na wala naman sapat na basehan ay somehow naawa ako for Nicole.

    But again wala akong kinakampihan…kaya ako instead na sishin ko kung sino man sa kanila…ay winiwish ko na lang na sana makapagpatuloy sila(Nicole and US Marines) sa buhay ng payapa, tahimik at walang bahid ng anumang pangangamba…sana sa kabila ng mga pagbatikos sa kanila ng ibang tao ay magkaroon sila ng katatagan na humarap sa buhay…at syempre matuto HINDI lang sila kundi lahat (both Filipino and Foreigners) sa pangyayaring ito!

    Kaya imbes na magsisihan at magbatikusan ang bawat isa…makiisa na lang tayo sa pagsira sa VFA na lantarang binabastos ang gating Constitution at mga karapatan natin bilang tao!.

    I presume you’re an American. well actually my friend, you don’t have to be distress if you heard some people here in the Philippines are anti-Americans because they are only very few. in fact these people are very unpopular because of their link to the communist-terrorist group NPA(New People’s Army). in many sites with many comments about the subic rape case, 90% of the comments made by Filipinos are pro-Smith. i am a university student and i had made a survey together with my classmates about the case, we got almost the same results. however in some websites, it came out that most comments are anti-smith because of biases of the editors. they don’t posts comments against the said victim of rape. i think that’s all i can say.

    actually, if you read through the comments log, a lot of them espouse the same rape jurisprudence as the taliban or islamic fundamentalists, not philippine nor american jurisprudence. all those about questioning nicole’s morality, or presence at a bar, or intoxication, or accusing her of being a sex worker — you’ll find all those mitigating (even extenuating!) circumstances for rape in such places. thank god for the legal writings of justices davide, ynares-santiago, et al, else we’d be in the same boat.

    gusto ko lang po magtanong, isa pa po akong nursing student graduating na po isang simpleng mamayan.. ganito po meron po akong pinsan na 15 years old, siya po ay nabuntis ng isang 20 years old na lalaki. ngayon po after 4 months pa po ito nalaman ng magulang niya. ayon po sa pinsa ko siya daw po ay pinilit at tinutukan ng baril. ngayon po idinemanda ng magulang ang lalaki pero hindi na po tinanggap ng fiscal o sa korte dahil 4 months na daw po ang nakaklipas. ito po ba ay isang statutory rape na maituturing?? bkit po pinakawalan pa ng fiscal ang lalaki? salamat po.

    Hmm.. well, late man to, gusto ko lng mag comment,, this thread have gone a long way.. and ang ending ng issue? wala ding nagyari sa kaso. yeah, Smith was guilty as the court’s verdict..pero what a twist of the story, ‘Nicole recants’ ang sumunod na issue.. Oh my.. Pera- Pera lang pla talaga… Ngaun, im so positive na why I just don’t have a good feeling about Nicole.
