Like thieves in the night

(N.B. This is Teresita Ang See’s Beats and Bytes column in Tulay, a Chinese-Filipino digest published by Kaisa Para sa Kaunlaran. The author is an awardee of The Outstanding Women in the Nation’s Service [TOWNS], one of the many organizations helping Nicole.)

Faust sold his soul to the devil for short-term personal gain. The Philippine government seems close to doing the same.By agreeing to give the United States custody of convicted rapist, Lance Cpl. Daniel Smith, the Philippine government has practically sold out the country’s sovereignty. The convoluted logic given by Malacañang spokespeople: The move is better than a pardon for Smith, and it will ensure continuation of the joint military exercises. Excuse me? These statements raise two sore points.

Firstly, pardon is not, and should never be, an option. It should not even have been mentioned. A pardon would make a mockery of our judicial system. Pursuit of justice and due process become a cruel joke when political interests can easily subvert results unsatisfactory to those with influence.

The second point indicates that foreign military interests are so important that it is OK to bump national sovereignty and justice onto the back seat. Karangalan and katarungan, twin ideals for the nation, have just been decimated.

Sad.

The Chinese have a saying “Qiong guo wu wai jiao (A poor country does not have foreign relations).” A poor country cannot demand equality and parity in foreign relations. Our government has just proved how true this is. Under duress from the U.S. Embassy, we sold out.

Like thieves in the night, police operatives sent by the Department of Interior and Local Government spirited Smith out of the Makati City Jail into the waiting arms of the embassy staff last Dec. 29. This covert act was done by virtue of a clandestine executive agreement between U.S. Ambassador Christine Kenney and Foreign Affairs Secretary Alberto Romulo. It was done at the very last hour of the last working day of 2006, an assurance that the camp of rape victim “Nicole” could do nothing to prevent it.

Malacañang’s move skirted Makati Judge Benjamin Pozon’s order that Smith’s custody should be with the Philippines. It likewise contravened the Court of Appeals’ decision that while the case was under review, Pozon’s decision should be respected. Finally, the appellate court upheld the conviction but rendered the custody issue moot and academic because Smith had already been transferred to the U.S. Embassy.

Instead of caving in, the Philippine government ought to have thanked the Americans when they decided at first to cancel the scheduled Balikatan exercises. It ought to have seized the opportunity and cited Nicole’s experience to tell the U.S. government to exercise prudence and keep their military men out of any country, not just the Philippines, until it can assure other countries that their citizens will not be abused, raped, massacred and degraded by rampaging soldiers.

But no, Malacañang buckled under the weight of threats coming from Uncle Sam. And bully the Americans can. Initially, Ambassador Kenney warned that U.S. mercy medical and relief missions to typhoon victims might suffer if the Philippines does not hand Smith over. Stunned by the backlash of such blatant bullying—that withholding aid would be much like snatching candy away from a crying child—she later backed down.

So it was onto the next threat: To cancel the military exercises. This time, the strategy worked. The Philippine government’s response sold out our dignity as a nation. It has allowed a foreign government to interfere in our internal affairs and subvert our own judicial system.

I do not subscribe to the saying that a poor country does not have foreign relations. We can still hold our heads up high in the community of nations if we keep our dignity and refuse to bow to a foreign power.

I cannot believe that our government officials would ever buy the line that our relations with the U.S. would suffer from the issue over custody of a mere corporal. But it did and I believe that what the President and her officials fear is the loss of U.S. support which she needs for her political survival. In much the same way that the U.S. continued to prop up the Marcos dictatorial regime to the very end, President Gloria Macapagal Arroyo and her minions seriously feel that they cannot sacrifice that political backing over the custody of a lowly U.S. marine. But clearly, they too miscalculated the consequence of that move.

The Palace rah-rah boys are one in saying that the President had nothing to do with the decision. But they also admit that Cabinet cluster on national security (Cluster E) made the decision. Palace officials are adding insult to injury by trying to pull our collective leg. How can a Cabinet cluster’s decision be concealed from the President?

Come on!

They could not even get their acts and pronouncements together. National Security Adviser Norberto Gonzales had already announced that the custody issue would not affect RP-U.S. relations. Then Executive Secretary Eduardo Ermita and spokesman Ignacio Bunye justified the custody change because, they said, the government does not want such issues to affect relations.

Even more tragic are the female bystanders swooning over Smith and professing their belief in his innocence. It is sickening that these women can ignore the suffering and abuse of one of their own just because the criminal is a young, handsome, white American boy. I wonder what they would feel if the African-American marine were convicted instead.

Before we at TOWNS (The Outstanding Women in the Nation’s Service) decided to help Nicole, we did our own fact finding and talked to Nicole and her family and some witnesses. We are fully convinced that Nicole was raped and that all she wanted was justice, not to get money out of the Americans. But many people, including Fr. James Reuter, did not bother to know the case and the family, and even dared pass uninformed judgment on Nicole.

If anything good at all is to come out of this tragedy, it is the review of the Visiting Forces Agreement. Filipino negotiators must clarify all the gray areas that have worked against Filipino interests.

We have to thank Nicole’s courage in facing the yearlong trial and her persistence despite her lack of resources and the mental duress in every trial.

We thank also the other women who stood steadfastly by her, especially her counsel Evalyn Ursua who bore the heaviest burden in Nicole’s defense.

No matter the final outcome of this case, we have won our victory in this battle. Like Faust’s story, it is human persistence and caring that win the day

    Before Fr. James decided to defend Daniel Smith, he did his own fact finding and talked to Dan and the other 3 marines who were witnesses. He is fully convinced that Nicole was NOT raped and that all Dan wanted was to clear his good name. He was never open to any settlement for a get out of jail free card because he truly believed that the truth would set him free. But many people, including TOWNS (The Outstanding Women in the Nation’s Service), did not bother to know the case and the marines, and even dared pass uninformed judgment on Daniel.

The way I am looking at this, the U.S. is having problem demanding equality from the Philippines. Having problem agreeing with an Agreement call Visiting Forces AGREEMENT. Oh oh.. How about a FAIR TRIAL?

    You actually think Ursula, is very into Nicole? No she is into the business. Come one, you talk about the U.S. having interest. Can you imagine how many potential Banking clients will be asking for Ursula? If Ursula is really Fair, then she should have been attentive on Pozon’s comment “I have a daugther too”.

    How many Filipinos are benifiting from the U.S. Philippine Relation. Can Philippines stand on it’s own right now? It shows how much you really care about many Filipinos. For those of you who can afford to go to an internet and read and write and have a house, eat three times a day, steady job, but bias think the philippine can stand on it’s own? HECK NO! You need foreign relation. How much stable the Pinas economy was when the Base was there? Tourism for example. Trades… If you don’t have foreign relation, how are you going to sustain Philippines. No trades, no tourism. All about freaking complain about this country and that country but NO SOLUTION has been provided from all this complainers. You claim you care about the Filipino People but in all reality, you care about what you think, you care about people aweing your bias articles, so later on you can sell more of your interest and use it for your advantage. How are the Americans going to benifit from that, and how are the Filipinos going to benifit from that interest.

    These would have all been avoided if the Philippines were not so reliant on the US for it’s national and admit it…financial security. Stand on your own two feet, Philippines…then you can talk about pride(karangalan). As far as katarungan…it wouldn’t be so suspicious if the whole thing wasn’t so biased against the american. He was made as a scapegoat so leftist groups can have their field day. If Nicole was sober and did not exhibit any questionable behaviour prior to the alleged rape…I’m sure she’ll have more support from the “common tao”…you know, people that are not members of any groups and have no agenda. Maybe you can ask the Chinese government for military and financial support instead… I’m sure they’ll provide you with the kind of pride, justice and respect you’re clamoring for.

    One of the worst comments I read in this site is asking Atty. Ursua not to run for an elective post. This one is both ludicrous and sad. Whatever gave TK the idea? or Whatever brought TK such pessimism that all person who do very well in helping others are only out to amass electoral votes for an earn a seat in politics.

    For some of us who witnessed how our relatives, friends, colleagues, acquaintances were steadfastly defended even Pro Bono by Atty. Evalyn Ursua over the years know how hard she works if only to save one abused soul and promote equality and empowerment of women. TK, remember that while the other private prosecutors turned their backs on “Nicole” when the going got tougher, Atty. Ursua remained and fought the hardest and won. When almost everybody believed it was a losing battle, Atty. Ursua defied the Act of Surrender by the forces who were supposed to have defended and protected Nicole from such a barbaric act.

    And you know what, maybe to most of the lawyers’ surprise Atty. Ursua was right in believing that she will win the case. She did her work as far as she was allowed to and Nicole won. Undoubtedly, had she been given the chance to cross examine on the other suspects who were with Smith that time, they too would have spent their Christmas in the compound of the Makati City Jail.

    Taking a cue from Teresita Ang See’s article, I remember when Sec. Norberto Gonzales upon his visit in our university, answered without batting an eyelash that “Nicole” had no chance of winning or even fighting for her case because of the VFA. Those words coming from the country’s National Security Adviser…an irony isn’t it. He should have have been dismissed from his post a long time, for he knows not how to provide security to the country and best of all the hapless countrymen. What advice can he give anyway?

    Well, GMA called on understanding that giving the US custody of Smith was necessary for the greater good. This utilitarian view was proven wrong when 3 areas in Mindanao was not saved by the US forces from the series of bombings in Gensan, Kidapawan and Cotabato. And where are these US forces detailed? Here in Mindanao. The belief that the US forces can save the coutrymen from threats of terrorism has once again been proven to be a Myth after all.

    What is real is that a young Filipina woman was raped by L/Cpl. Daniel Smith. And to make more emphasis, I can’t remember Fr. Reuter ever providing a clearer proof that these men did not rape “Nicole”. I can only remember that he believe them. So between him and the facts gathered by Atty. Ursua and those who work with her, I Atty. Evalyn Ursua is much, much more credible.

    So if TK’s assumption is right and Atty. Ursua runs for office, I’ll vote for her. Why not? At least for many instances she never cowered in fighting for her countrymen unlike the one holding the Presidency and her luminaries.

    But of course, I prefer that she remains a lawyer fighting for women and other causes. There are already more than enough lawmakers and politicians lording over this hapless country.

    She is truly a big loss to this country if she ceases to be one and at the rate “Nicole’s” case is going beside Nicole and her family she is hit the hardest.

    Nicole is suffering not because Pro Smiths wants to. Nicole is suffering because she wants to suffer. LIFE IS A CHOICE.
    Maybe it is not because Smith is a young, handsome, white american Boy… Maybe because they have problems believing Nicole or… Maybe Nicole is labeled as a slut or a prostitute.
    Did you go around and ask those “Female Bystandards” why they are swooning over smith and you came out with that CONCLUSION?
    So you wonder what would have been the outcome if Smith was an African American?
    So you are insinuating Americans are racist? Watch what you say… you need a good for this one.

    Ursua clearly lied . At the onset of the case she stated Nicole does not like it when she sees a woman sitting on a mans lap. Ursua attacked the VFA before the case was even finished. That was on her agenda from the beginning. To gain fame and in the long run lots of money. In my own opinion she could care less about Nicole. She is a private lawyer, the VFA is not her concern. It is not her concern where smith is confined. She did her job, now it’s time to leave Smith and Nicole alone.

Ursua a private lawyer; she is, more than anything else, a Filipino, who does not want to see her country being trampled on by imperialists. the VFA was incessantly attacked precisely because it governed the entire case – the defense, the us embassy and its cohorts stubbornly held on to its provisions. the “fame and money” you are talking about are.. well, inconsequential at the most. where did you base your opinion that she couldn’t care less about Nicole? do you personally know her? let me remind you that the VFA is a concern for every Filipino. we owe it to our country to stand up for its integrity. the very Sovereignty of our nation is at stake in this case.

How did you Know I was talking about URSUA? You had to correct me so you can feel righteous? Well now you feel righteous? Good.. Now is Nicole Righteous? Didn’t change anything, did it?
    YES! NO is NO! Can Nicole prove she said “NO”? Now can smith Prove she said ”YES”? Rape is Rape when IT IS RAPE. What if Nicole is Just Stipulating? What if smith is Stipulating?

    these women’s groups had been there for several rape victims long before this issue erupted. nicole’s case was simply the most prominent. please read our other entries. we’ve answered that allegation again and again.

    Ms. See is right, I agree that the government of GMA did hijack Smith, this could have been avoided had they filed a habeas corpus petition with the SC as what Mr. Saguisag stated in his coloumn.

    Atty. Ursua is one good lawyer and I salute her. She was able to get a conviction based on circumstancial evidence, such a feat in a corrupt system is truly amazing.

    Mr. Pozon handed the verdict and one of the points he raised was he did not see any reason why he should not believe Nicole. I am hoping that I can have a better grasp of what just happened and if anyone here would be kind enough to enlighten me with some issues I have:

    1. If Nicole was telling the truth then everyone else is lying? Upon reading the proceedings posted in this site I see consistency in their statements corroborating each one. The incident in the courthouse wherein Nicole claimed she was tripped by Smith and in her outburst scandalously hit the accused with her handbag. Ms. Ursua’s legal aide was with her and she stated that Nicole was not tripped it is just that the space is too tight, was Ms. Ursua’s legal aide lying? If the legal aide is telling the truth then Nicole is definitely lying. If she can lie about this inside the courtroom in front of many witnesses what is the probability she also lied regarding her accusation of rape?

    2. Why was the Filipino driver not asked to testify in the court proceedings? He could have shed light into the case and with the threat of perjury charges against him he would have testified based on what he saw and heard. Which of the statements are true? The one he gave to the investigatong that it was gang rape or the ones he gave to the marines that it was consensual? The problem with the Philippine justice system is it is always the poor small people that are easily harrassed and intimidated and the bad habit of inept investigators of charging everyone wholesale including the witness.

I also wish that same groups would further women’s causes by educating them that true empowerment is not the ability to garner support after placing onself in a compromising situation by bad decisions one made but by avoiding said situations in the first place through self respect and common sense. “Nicole” is so not the kind of woman you want to use as your “symbol”. Doing so is just irresponsible. It still was not rape and Daniel Smith is still being used as a political pawn.

    Fr. Reuter has devoted his adult life loving Filipinos through thick and thin. He may be old but he is still an intelligent person. I don’t understand all that criticism that was directed at him when he supported the side he believed was telling the truth. I’m not Roman Catholic but I admire the man for his selflessness. He probably loves the Philippines more than a lot of Filipino leaders and activists do.

    I’m a Filipina but don’t find Nicole’s testimony credible either…too many inconsistencies. And the lynch mob that’s ganging up on a 21 year old boy does not do much for Philippine dignity.

    To add to Dude Labo’s comments, no. 18 above, regarding Judge Pozon’s declaration that he saw no reason why he should not believe Nicole: a number of others would also appreciate being enlightened on that score. It would help ease a lot of people’s anxiety and worry that a young boy is being sent unjustly to life in prison. One reason why I was surprised with the judge’s statement was that Nicole’s own lead lawyer, state prosecutor de los Santos, had called Nicole and mom ingrates and accused them of lying from the start, “Ingrata! Sinungaling sa simula’t sapul! Kailan sila naging consistent?”. That was not presented in the court hearings but it was all over the media. Judge Pozon could not have missed that.

    There’s also Nicole’s not remembering exactly how many men allegedly raped her in the van. First she accused several men of physically assaulting her. She told Subic bike patrolmen Noel Paule , “sabi ko sa kanila, tama na, tama na, pero sige pa rin sila”. She first set the number at six. Then it was reduced to four when two of the men proved that they were not in the van. Then it was subsequently changed to only one man Smith allegedly raping her while the other three were conspirators who allegedly cheered Smith on. Judge Pozon ended up acquitting three, and that was announced at the same court session when Judge Pozon declared he believed Nicole. It just boggles the mind.

    When patrolman Paule found Nicole at the Alava Pier shortly after the marines dropped her off, Nicole embraced him and told him not to leave her–“Dito ka lang, huwag mo akong iwan. Pag nalaman ito ng Mama ko, papatayin ako.” I find it odd that only minutes after allegedly being raped by male strangers, that she would easily embrace another male stranger. After a rape, the victim usually feels taken advantaged of and soiled. I would think the last thing she would have needed at that moment is to touch another male. After the verdict, she even wanted to visit Smith at the jail. Talk about aversion.

    The driver of the van told his story in an article in a December 11, 2006, in the Philippine Star, and explained that he was not asked by the defense to testify. He corroborated the marines’ testimony, but unfortunately this was after the trial. Note Atty. Ursua trying to threaten him. http://www.philstar.com/philstar/show_content.asp?article=291619
    One TV report mentioned that he had to go into hiding. I think he is another victim in this case.

    A filipina was raped by 17 men in kawait not long ago, Not one article has since appeared in any papers , there have been no protests, no womens groups burning flags, screaming for justice in the streets. Not a web site justice for that filipina anywhere to be found. This case was never about rape, it was all about hatred toward americans. Call it as you like, smith and nicole were used as the fuse. Who cares what jail smith is sitting in, the american taxpayers have to flip the bill not the filipinos, They want the VFA, then they pay. Concentrate on cleansing the country of terrorists and fight corruption. The united states isnt the worlds savior, but they do try to help. The filipines just put a major dent in the abu sayaf network with the help of the americans. This is in every filipine newspaper. All I read about is protesters burning american flags, the VFA, I though we were here to discuss the Nicole- Smith case. I’m not a racist, I don’t care where smith spends his days, I would imagine that if he is put in an american jail big Bubba will be waiting for him and who pays for his food, cloths, medical,,, the american taxpayers.

    Claire Ynagan Thank you for offering more insights on how Pozon’s verdict has puzzled people like me. You maybe right that Soriano the driver may have been the victim here. A sad reality in the pathetic judicial system where small poor people who happens to be in the wrong place at the wrong time in witnessing a crime or alledge crime are always subjected to abuse and harrassment even death when protagonist are powerfull people are involve.

    Rearding Fr. Reuter’s, I believe that his years of experience in dealing with people as a priest has earned him a notch above when it comes to judging people’s character.

    Compared to Mr. Pozon who told the press that his decision to convict Smith was based on seeing in Nicole his wife and daugther only showed he is biased and hopefully that he did not have that sentimental emotional attitude at the onset of the case. Clearly it is the letter of the law and factual evidence that must prevail in any judgement and if the judge can openly admit to his bias and for Nicole’s supporters to applause said mental state only weakened their quest for justice.

    Rape is rape, anyone can be a victim even prostitutes but one has to accept the fact that rape is a case that is hard to prove and makes it more difficult if it involves one with questionable moral standards and the circumstance sorrounding the event.

    I was upset when I heard the news about this incident on how these marines treated a woman with utter disrespect in dumping her with her pants half way down in public at that is outrageous. An act unbecoming of an officer and a gentleman and in a foreign country at that is unnacceptable and they should be made answerable for their misdeeds. Their misdeeds will of course create animosity and hatred among the population and rightly so fueled another anti-american outburst with some sectors bordering on xenophobic rants. That I concede is morally wrong but the big question is was she raped? Based on her inconsistent declaration and wholesale accusations where everyone at the site including eyewitnesses are accused of the alledged crime only shows how inept and lazy are the Philippine investigators.

    I am not justifying the marines for their disrespectfull actions, no excuse whatsoever but I also accept the fact that you can’t demand respect in an environment where respectability is nowhere to be found. Whenever a big concentration of US military personnell on R&R in thirld world countries are they act as magnet for prostitution. To be accused of rape is another story and if it happens that it was an act of a scorned woman then justice was not served. This maybe a case of injustice, a punishment for an imagined crime sending an innocent man with a verdict not grounded on reasonable doubt but on a biased judge to quench the mobs thirst for blood and revenge for their disrespect to a Filipina woman.

    In Ms. See’s other article she justified Nicole’s demeanor and her mom’s insistence on going with other marines on vacation at Subic because they are “promdi” (from the province) thus their “naivette”. A naive “unsophisticated” Nicole who seems to be scandalized at the sight of other woman sitting on a gentlemans lap seems to prove that point. What is puzzling is why was she not scandalized at her own demeanor when she danced with a stranger and allegedly flirted with Smith don’t seem like she is one “naive promdi” after all? Was it her naivette that she did not notice that the bar she just went in has in-house “bar girls” where even the security guards act as pimps while on duty tells you what kind of establishment that is? If she was looking for her knight in shining armor that will swept her off her feet, it was the wrong place and inappropriate place to find one, besides she already has an American boyfriend. Women who go to bars acting the way she did are mostly free lance prostitutes or loose good time girls who wants to get “lucky” and the chances of her being treated as one is most likely than being treated or mistaken for a Mother Teresa is very unlikely. It is obvious that she was seen as one when one of the marines uttered the B word in disposing of her which elicited an angry tantrum of denial from Nicole, could this be the reason why she accused them of gang rape? If the tetimonies of the marines were given any weight it would explain why she was dumped the way she was.

    I was reading an old article about Judge Pozon. Its titled “Makati judge feels he did right in Nicole’s case” . Pretty good article. I can see why Judge Pozon would feel he did right. He did what he feel is right, not did what is Right. This goes to what is Called “letter of the Law, Spirit of the Law” . It is really hard to be in his shoes. Imagine what he is gonna go thru when he ruled in favor of smith. All these organizations will all up in his butt. Imagine what his kids will go thru. He was in a no win situation but I bet you he did what is going to benifit him or be the safest for him and his family. Reading the article it was also mention that when he was writing his historic decision he almost shed a tear.
    Judge, I know your job is hard but if you are put in that position and you accepted that position, do not involve yourself emotionly. You are messing with people’s lives that way.
    Judge also stated: “Both of them, the complainant and Smith, are very young. And I am a father, and I also have children, so it was really very hard to decide,” said the father of three”
    What can you comment on this?

    What are those emotions? Do I sense guilt from someone?

    She said Smith seemed far too young to waste decades of his life in jail. But at the same time, she said, she wondered how she would feel if Pozon had acquitted Smith.
    If she was really raped, then she won’t have to worry, wouldn’t she?

    Anne, Apology on that. But if the case is proving Nicole a slut rather than proving she was rape and we are going by testimonies like how the rape case went, then Nicole will be proven as a slut. Now if there is a Bantay Karapatan group, then They should be supporting Smith Also because Smith has KARAPATAN as much as Nicole has. When you think of rights, you should think about equality. Every rights nicole wanted was given to her after the rape. Winning the case got nothing to do with rights. She complained and she got it. She took it to court, she got it (Even though it was said, it was no case). Winning is not a Right unless it was decided without bias or pressure (gunpoint).
    Now can it be honestly say, the decision was unbias.

    You will notice that all countries that have good presence of U.S. Military and good exposure on U.S. political economy has somewhat stable economy. hmmmmm
    The Japanese are Giving the U.S. money to have a Military Bases in japan, while back then The U.S. gave the Philippines money to have military bases there. Oh not to mention the U.S. Advance paid the Philippines to stay there and the Philippines kicked the U.S. out early. Now, where did the money go? And how was the economy then compared to now? Maybe? affected a little?

    the money you probably speak of was military aid… mostly in the form of aged, decrepit, vietnam war-era hardware — cast-offs and rejects. there is absolutely no parallel with such aid as opposed to the aid such as f-14s and M1A1s given to israel, patriot batteries to taiwan, or aegis systems to japan.

    The only thief here is Nicole. She has falsely accused a young man of a crime that didn’t happen. She was the agressor and started everthing that happened. Why would she go with 4 men into a van? Why would she be dirty dancing all night with the accused? Why would she kiss the accused all over his neck for most of the evening? Why did she help put on the condom? Why would she be mad when it didn’t last very long because he had a curfew and had to get back to the ship? Why would she go back to the bar looking for the accused when she knew he had gone back to the ship? Why if she was ” unconscious” does she remember everything that she said happened? Why did she wait so long to go to police and the hospital? Who said he wasn’t as drunk as her and she raped him? I’m really confused here.

    It is a sad analogy to allow a convicted rapist go scot-free just for a generic notion that the US led forces are the very reason why the Philippines will be free from terrorist attacks. I never realized the presence of a pervasive assumption that our Armed Forces are incurably incompetent and paraphlegic to defend the entire Filipino citizenry from the furious attackes of terrorism and the like. Pitiful, but I remember they got the biggest chunk of the country’s budget.

    Truth remains, as there are terrorists so are the breathing presence of the Imperialists. Why else does one American President feel like he is the president of world? He, who has the penchant to meddle in other country’s affairs, claiming basic rights to bomb, extinguish, even hang alleged enemies of the state not his own, undermining the lives of hapless, innocent civilians who are caught in the middle of a more confusing war more than they can ever comprehend.

    So, if the super president can help send a condemned President to be hanged unceremoniously, what more allow his young boy go scot-free from rape?

    Well, a few days ago an armed and intoxicated US soldier was in bar somewhere in General Santos City. He caught the ire of the media community and local folks when he hurt one of the mediamen present. That is loathesome! When interviewed, an official of our Department of Foreign Affairs laughed off the issue saying “it is a Non-story”. That answer irked me even more.

    Imagine, lest they face another VFA-related controversy, DFA officials just laugh off these scandalous acts. Haay. How I wish that guy be the next victim of such stupidity.

    For all her struggles in winning and keeping “Nicole’s” case afloat and for all what they have been through Atty. Evalyn Ursua and Nicole are the surest victims of Imperialism. Believe it or not, that is beyond hypothesis. Furthermore, contrary to wondering’s belief, Atty. Ursua is not holding “Nicole” captive, rather it is the thought that “Nicole” would rather be mum and go on with her life is the one actually scourging and crucifying. But of course, Atty. Ursua will never allow that to befell Nicole and to any of her clients.

    Going back to the Imperialists, how I wish they will fight terroristic battles from their country so as not to divert the venue of the war they have created.

The latter communiqu6 also signalled forthcoming major revi-sions in the U.S.-Philippines Bases Agreement. What those revisions involved was revealed in the amendments that were made public on January 7, 1979. One of the most enduring disagreements involved the issue of compensation to the Philippines for the bases. While the original agreement gave the U.S. use of the bases “rent-free,” it was clear that the Philippine government expected to receive and, in fact, did receive some kind of “compensation.” The U.S.-Philippine Military Assistance Agreement of,1947, signed just one week after the bases accord, was considered by Washington and Manila, at least in part, compensation for U.S. use of the bases.

    REAL victims of rape sustain grave psychological trauma requiring years of therapy. None of them would want to relieve any situation that lead to the crime against them, I assume. Two theories I’ve been toying with for the answer:

    The most gullible person is this case was the judge Pozon. Any fool can see both parties were at fault. Smith took the fall regardless. Nicole was never held accountable for her actions. She walked away labeled a victim. I wanted to see a fair trial but that did’nt happen, Soriano was conveniently kept from testifying. So after all, it is very possible an innocent man is sitting in jail.

    Down at Subic over the last few weeks with the Essex and a few other US Military ships in dock and so many sailors on shore leave it was interesting to see the hundreds and hundreds of Nicoles throwing themselves at the sailors, sitting on their laps and drinking themselves into oblivion all in the name of what they can earn from a few hours with a Sailor.     My response may be almost a year too late but here goes… I work with victims of rape here in the US and the ones I’ve encountered never or are very hesitant to go back to the “scene of the crime” so to speak. I guess your Suzette is a special case. I think you’re the one needing a specialist at this point…it’s kind of hard to stay away from the truth and keep supporting a lie without getting too stressed out.

    Suzette was used by Gabriela, Maza, Hontiveros, Madrigal, Salonga, anti-Americans., etc.

    Smith was used by Judge Pozon and the Philippine Judiciary System.

    The Philippine DOJ must investigate Suzette’s lawyer, Evalyn Ursua, and Gabriela, Bayan Muna, etc., and find out if Ursua wanted Suzette to give false testimony.

    If proven guilty, Ursua and her groupies could go to jail from 6 years to 40 years.
