About the Nicole Information Bureau

The Nicole Information Bureau is the information arm of the Nicole Defense Campaign launched by awardees of The Oustanding Women in the Nation’s Service (TOWNS).

The bureau itself was created in June 2006 under the supervision of Dr. June Pagaduan Lopez, former director of the Center for Gender and Women Studies of the University of the Philippines-Manila, freelance editor Paulynn Paredes Sicam, formerly of Cyberdyaryo, and Tess Glinoga, a writer and rape survivor.

Its mission is to:

(1) provide the public with more accurate, more complete, and more sensitive updates of the trial and other helpful information on the Subic Rape Case;

(2) help prepare Filipino society to deal more fairly with victims of rape and sexual assault by educating the public on the psychological and social issues attached to rape;

(3) educate the public on the anatomy of rape as a heinous crime and a clear violation of the rights of women; and

(2) persuade Filipinos to see beyond the superficial and appreciate the social, and political implications of this case.

Apart from maintaining this blog and writing summaries of the trial, the bureau also monitors media reportage (television, radio, print, online) and public opinion on the issue. It also plans to conduct public forums to help raise people’s awareness and understanding of rape in general and Nicole’s case in particular.

The bureau is composed of volunteers, most of whom are students from the University of the Philippines-Diliman.

If you want to join the bureau, or help out in the case in any way you can, please email the blog administrator here. We would be very glad to have you join us.

Press release to the Philippine Media

    Nicole versus the US Marines

We are told that the job of the US Marines is to defend those who are unable to defend themselves.
The least the US Marines could do while visiting the Philippines is to defend women like Nicole from being raped by fellow-Marines.
Isn’t it enough that the US Marines are here to train Filipino soldiers to be more efficient at killing fellow human beings? In the meantime, must they also carry the impression that women of the Philippines are not worthy of love and respect or a decent treatment?
To Nicole: as an American citizen living in the Philippines, I have every wish that you will succeed putting in jail those cowards in US military uniform who raped you. And even if they did not rape you, for treating you like a piece of garbage, they deserve to be thrown out of this country.

    Yours faithfully,

    For Nicole

She said: “There is no justice in the Philippines, and it’s the reason criminals are running the place.” The victim of rape by a US Marine while fellow-Marines cheered him at his job, Nicole further said: “The justice department is the top criminal.”

It seems Nicole’s team of prosecutors in court are more on the side of the rapist than on the victim. ( See Manila Standard Today ( Oct. 11, 2006 ).

For my part, I have the greatest respect and admiration for Nicole. What a rarity of a Filipina. She is so courageous and so principled. If only more Filipinos had a mother like a Nicole; had a wife like a Nicole; had a sister like a Nicole; had a daughter like a Nicole; had a niece like a Nicole, and indeed had a teacher in school like a Nicole – the Philippines would be the most decent and the most developed country in Asia today. And to think that most Filipinos, specially those with college education in this country have other more important values and beliefs. Such as in this God-forsaken country, these college educated dummies would rather be waiting for the Second coming of Jesus Christ, if not looking forward to a better life to come in the hereafter after death in the Kingdom of God. “We are told that the job of the US Marines is to defend those who are unable to defend themselves.”
You were told right, but doesn’t take them away from being “human” who make mistakes like you and me and even nicole. Life is about a choice. CHOICE a big word. Let’s talk about priest and altar boys.

The least the US Marines could do while visiting the Philippines is to defend women like Nicole from being raped by fellow-Marines. Nicole was drunk but she had an excuse, Smith was drunk he had no excuse. Read some articles like dirty dancing with Smith and see who is the predator. It take two to Tango.

“Isn’t it enough that the US Marines are here to train Filipino soldiers to be more efficient at killing fellow human beings?”
Choice again, Must separate the word elliminating the threat and killing. You don’t need to kill to illiminate the threat. Where does CHOICE come in play. In war you have a CHOICE to surrender or fight. You must defend yourself as much as you can if it is a must to take away ones life to survive you do it. You must be there to believe, killing is not the goal, it’s self defense and defense of other. Marines are trained to illiminate threats and surrendering is a CHOICE. Do you know what happens to a soldier who kills a person who surrendered? UCMJ…

“In the meantime, must they also carry the impression that women of the Philippines are not worthy of love and respect or a decent treatment?”
Philippine Women”All women” are worthy of love and respect but is that the impression Nicole wanted. First impression is the lasting impression. How did nicole represented the Filipinas in the Bar? Isn’t the saying “respect is earned not given” applies here or omitted?

“To Nicole: as an American citizen living in the Philippines, I have every wish that you will succeed putting in jail those cowards in US military uniform who raped you. And even if they did not rape you, for treating you like a piece of garbage, they deserve to be thrown out of this country.”
But Nicole doesn’t want them thrown out of the country She actually wants smith to stay in P.I.
I see you haven’t given up your citizenship but yet you cursed at the American, remember, there is a “CHOICE”. It is also a choice to sound like a hypocrite.
It was your choice to make some comments without reading more about Nicole, so I really don’t blame you poch.

I probably agree with NICOLE stating the Justice is one-sided. THAT IS WHY SHE WON… RIGHT?

Nicole Is the Victim of rape.. The Rapist name… is Daniel Smith… If this rape had taken place in any other country the Victim of the rape would be the one that gets supported..
Its strange to think that there are some that would support a Rapist … and not his victim….

Daniel Smith carried Nicole to the Van.. over the next 25 minutes raped her held her down and inflicted brutal injuries to her… all while being encouraged by his brave U.S Servicemen Buddies. Then Smith abused her and two of them dumped Nicole in the street by the Pier Half Naked… They Threw her underwear nearby with a condom still sticking to it.. and ran off.. This was witness by more than 12 people on the Pier.
Two of them contacted the Shore patrol police and reported a suspected Rape…

The Evidence presented in the court.. by 23 witnessed was overwhelmingly against Smith… He was found Guilty and is now a Convicted Rapist.

The sympathy i feel is for the Victim.. not the Rapist.

    To “bryan” and “YT” =

What you are implying is that Nicole came from a lowly, or perhaps deregatory, background and that it was her “choice” to be in that situation?! Are you crazy?!
Even if a person is a prostitute, nobody has the “choice” or right to rape her! Rape is never a choice. Rape is a crime!

From my understanding of the whole rape case, “Nicole” was allegedly drunk when the supposed rape incident happened. All I can say is that she shouldn’t be drinking in the first place because every sane person knows that drinking clouds your judgment. Second, she shouldn’t have placed herself in that situation either. Drinking yourself to the point of passing out is just plain stupid. Yes, I said it…”Nicole” or whatever her name is, is STUPID. If you drink and pass out…and then get raped in the process, it is your own fault for putting yourself in that situation. She shouldn’t have drunk that much anyways. I don’t consider her a rape victim…she is a victim of her own stupidity for getting drunk. And now she wants sympathy? Excuse me?!?!

Oh by the way…if she was drunk…how can she, without any shadow of a doubt, accurately recall the events? I think she’s just trying to find someone to blame for her own stupidity rather than take responsibility for what happened to her.

I don’t support rape but I’m also not in favor of stupidity.

The only person in the van at the time Nicole was there with the Marines was the driver. Did he testify that she he saw her being raped? I followed the trial in the newspapers and I don’t recall reading the driver’s testimony.

About the condom that was found with Nicole’s underpants: Was it DNA tested for Nicole’s and Smith’s bodily fluids? Was there any testimony about a condom being used in the rape? If so, did it stipulate how could Smith applied the condom while assaulting Nicole?

When the SBMA investigators proposed a settlement during their interview with Nicole, what kind of settlement was suggested — monetary, apology?

As for the medical examination of Nicole, was there any vaginal tearing or bruising? If so, could it be distinquished between previous sexual activity that day and that of Smith that night in the van?

A better description of how Nicole got in the van also would help to establish whether she was abducted or just assisted because of her drunken state.

Unfortunately, the prosecution appears to have botched the case and their mistakes left many unanswered questions that tend to incrimminate Nicole, the victim. Nicole’s behavior in and out of court added to the negative impression Nicole.

Hopefully, the Court of Appeals will stay on the facts and not the courtroom and publicly staged drama. The prosecution’s poorly prepared case may make it hard uphold the lwoer court conviciton.

yes, it was stupid of nicole for getting drunk…but please consider her age and her being a “probinsiyana”…she’s still young right?…and being a “probinsiyana” I assume she was curious about things…

and yeah, how come he was able to use a condom when it was a rape case…well…she was very drunk right?…and she was alone in the van…hmmmm…some people dont really think, dont they!

rape is rape…done forcibly without consent…irregardless of whether she’s of questionable character or not…

It’s just plain misunderstanding. All the drama and stuff. I don’t believe her convictions from the start. If you drink with a guy in a club till wee hours, we all know what’ll happen next right? Even ‘probinsyanas’, know that, i mean, especially them. Jeez! I hate it why such people make a fuss.
Alright, I know that everyone is entitled to mistakes, but not everyone is entitled to the burden caused by it. Perhaps it was about CHOICES, choices that would change a life forever. We can’t deny that the guy (Smith) is gorgeous, isn’t he? Anyone, even teens would have gone out with him, but then again, maybe, a mistake was the choice of choosing her among all the girls in the world, afterall, choices is what makes one’s life fullfilled.

Very few people know what actually happened – from their own personal experience – very few.
The truth is locked within their memories.
From that point onwards – “truth” is subject to spin, hype, manipulation, uninformed comments, wishful thinking, gossip etc.- plaintiffs, defendants, witnesses, lawyers, interested agencies – all can be party to this distortion.

OK – people are entitled to opinions – but care should be taken over a ruthless honesty – when their opinions are applied to sensitive cases like these.
