1. Why was Nicole in Subic?

Nicole and her two sisters were invited to Subic by Carlos Ocasio and Christopher Mills, both of whom are friends she met at the canteen run by her family. Mills and Ocasio used to frequent the said canteen, which is inside the Southern Command in Zamboanga.

Nicole, a Management Accounting graduate of Ateneo de Davao University, runs it. In his testimony to the court, Mills said he only wanted the sisters to take a break from working there everyday. He extended the invitation twice and Nicole declined twice, saying no one would take over her work.

Mils and Ocasio then broached the idea to Nicole’s mother, who called her younger brother, who was then in Davao, to ask him to go home and temporarily handle their business. When her brother agreed, her mother allowed Nicole to go to Subic with her sisters.

The girls boarded a plane to Manila on the morning of Oct. 30, 2005, and was drivent to Subic by their brother. They arrived there at around 6 p.m. of the same day. They planned to stay there for four days while visiting tourist spots such as Zoobic Safari, Bat Kingdom and Ocean Adventure.

2. Is Nicole a sex worker?

Nicole is NOT a sex worker. She is educated and comes in fact from a prominent family in Zamboanga. She started managing their canteen after she finished college. She tried to take up nursing in Ateneo de Zamboanga but stopped because she found it hard to juggle work and school.

As manager of their canteen, Nicole supervises personnel and sometimes acts as cashier, waitress, cook, or even driver.

Because of the canteen’s strategic location, their usual customers include Filipino and American soldiers ever since she was a child. Because of this, Nicole’s family trusted American soldiers and treated them like one of their own.

3. Why was she at the bar that night?

At around 6 p.m. of Nov. 1, Nicole and her two sisters were on their way to Grand Leisure Hotel, where they were staying, when Mills called. He said he was at the hotel and had ordered a Yellow Cab pizza for them. When they arrived, they saw Mills with his liberty buddy, identified only as Garcia.

After dinner, all of them, except Nicole’s 12-year-old sister Carmela, went to the casino of Legenda Hotel, where Mills and Ocasio were staying. They played blackjack and roulette until around 8:20 p.m.

Mills then asked them if they could go to Neptune Club because he wanted to drink. The night before, Mills, Nicole, Anna (her other sister) and Ocasio had gone there.

4. Was she really drunk?

Anna, who was with Nicole that night, and investigators of the Subic Bay Metropolitan Authority (SBMA) Intelligence and Investigation Office (IIO), who saw Nicole after the alleged crime, all testified that she was very intoxicated.

Anna described Nicole as “pasuray-suray” after swigging a half pitcher of an alcoholic drink called Bullfrog. It was the sixth drink that Nicole had that night. Other drinks that she took included Vodka Sprite, B52, B53, Long Island Iced Tea and Singaporean Sling.

Nicole had eaten only a slice of pizza before going to Neptune and wasn’t able to drink water or any other non-alcoholic drink that could have diluted the alcohol.

5. How drunk was she?

A team of seven toxicologists who examined Nicole’s case concluded that her alcohol intake on the night she was allegedly raped was more than enough to impair her cognitive and physical faculties and thus render her incapable of sensing or fighting off danger.

The toxicologists calculated Nicole’s blood alcohol concentration (BAC) based on the alcoholic contents of the beverages she drank, factoring in her metabolism and the time of the intake. The table below shows Nicole’s estimated BAC levels from evening of Nov. 1, 2005 to dawn of Nov. 2, 2005.

The team found out that Nicole’s BAC peaked between 11:00 p.m.of November 1 to 12:30 a.m. of November 2, around which time she was seen by Neptune Club security guard Gerald Muyot being taken out of the bar unconscious by accused Lance Cpl. Daniel Smith, and around which time the alleged rape occurred.

The toxicologists also found a positive correlation between her BAC levels and her behavioral manifestations as reported by witnesses.

Tomas Corpuz, another security guard at Neptune, had seen her walking “pasuray-suray” and “paikot-ikot” in the bar at 11:15 p.m. of November 1. After she was found at Alava Pier at 12:15 a.m. of November 2, Subic Bay Freeport bike patrolman Noel Paule reported seeing her crying and “parang lantang gulay.”

The testimonies of Corpuz and Paule on Nicole’s behavioral manifestations were consistent with the toxicologists’ calculations of her BAC. The table below shows the relationship between different BAC levels and their effect on the human body.

6. Was it consensual sex?

First, Nicole could NOT have consented to sex if she was that drunk. Several witnesses who saw her before and after the incident testified that she was very drunk, unconscious even.

A team of seven toxicologists corroborated that Nicole’s mental faculties that night was impaired such that she was renderred incapable of making a decision or sensing and fighting off danger.

Republic Act No. 8353 or The Anti-Rape Law of 1997 says rape is committed when a man has carnal knowledge of a woman “when [she] is deprived of reason or otherwise unconscious.”

Second, the findings of the medico-legal officer who examined Nicole two days after she was allegedly raped indicated forced sex.

Dr. Rolando Ortiz of James Gordon Memorial Hospital testified in court that the bruise on Nicole’s inner genitalia was consistent with allegations of sexual assault. He added that it indicated the forced entry of a blunt, cylindrical object into the complainant’s non-lubricated genitalia.

Ortiz said lubrication of a woman’s genitalia meant the woman was adequately stimulated for an intercourse. This usually happens during consensual sex.

Testimony from forensic pathologist Racquel del Rosario-Fortun also backed up Ortiz’s statement. Rendering her expert opinion on the medical certificate that Ortiz issued to Nicole, Fortun said in normal consensual sex, injuries, like the ones that the complainant sustained, are unusual.

Fortun further said that women usually position themselves to avoid being hurt during intercourse. She added that in consensual sex, a certain pelvic lift, partner assistance and vaginal relaxation or lubrication are usually present.

Fortun also told the court that human sexual response, which prepares a person for non-traumatic intercourse, is typically absent in sexual assaults.

7. Where were her companions when the alleged rape happened?

Christopher Mills, the friend who invited her to Subic, went outside the bar at around 11:20 p.m. to attend to his liberty buddy who had gotten into trouble with Shore Patrol.

Nicole’s sister Anna remained at the bar with her, but they were separated. The bar was crowded that night because it was a holiday. She looked for Nicole all over the place but failed.

By the time Anna saw Mills outside and asked his help in looking for Nicole, the bar’s guard and receptionist had seen an unconscious woman being loaded into a green Starex van.

8. Is Nicole only after the money?

Of course not. Nicole has been very persistent about pursuing the case from the start. In fact, early on in the case, a man named Ben Natividad from SBMA allegedly tried convincing her and her sister Anna to settle, but Nicole chose to pursue the case “because [she] only want people to know the truth and achieve justice for what Daniel Smith and the other accused had done to [her]. ”

In her statement released to the media last September 16, she said, “From the very beginning, my mind was set to pursue the case and not be influenced by other people by any means. My fight will be until the very end. I was never and will never be influenced by people surrounding me.”

She added: “When I engaged the services of Atty. Ursua, she told me that I have the option to settle, that it is my right. She asked me, what will you do if there is an offer of a settlement? I said to her that to settle is to think only of the short term, and I don’t want to blame myself that I did not fight. I know I will be bothered by my conscience someday if I did not fight and seek justice. I have come so far already, why will I think of a settlement?”

    No decent woman, especially a Filipina, will fly from that far south to Subic to party with a bunch of US servicemen. Would you take your own 12-year old sister for this inside an adult night club? That is sick!

    She knows, and her little sister knows, that she cannot handle her liquor but yet she went night clubbing that fateful night. This is not a decision that a sane and an educated person will make.

Jovito Salonga and Wigberto Tanada, who worked to remove U.S. bases from the Philippines in 1992, and Evalyn Ursua, the lawyer for the raped woman, filed separate motions with the appeals court asking it to let the Supreme Court resolve Smith’s petition because it involved “pure questions of law” regarding interpretation of the military agreement.
    Smart bitch hey???? She made sure she found more anti americans to handle smith’s case. I’d say it’s about time president Bush sanctions the philippines and severs all aid sent to the country. They,ve been nothing but a thorn in the americans side since WW2. When the japaneese were raping and murdering women and children and making slaves of them they sure welcomed the marines, the billions of dollars the united states gives them in aid for food and roads and schools can be used in america to help the poor thier too.     I have doubts about this Nicole character and all the fascist feminist pigs are swarming all over her like flies on dog shit.During the days when the U.S. Air Force and Navy had huge military bases here in the Philippines.I do not recall any women being abused unless otherwise they provoked it themselves.Maybe to get money from the Americans.     daniel smith is one person, he is not AMERICA. yes he is american but let me point out something i think got lost over the argument, many american people who worked in the base were good, God fearing people. if mr. smith did this horrible thing to a filipina it doesn’t mean that AMERICA raped the PHILIPPINES. someone raped someone and thats about it regardless of nationality this case should be treated like any rape crime, not because someone is american and another is a filipina we should argue that this is all about money and citizenship. a woman was raped you can’t put value on that.

    No woman will be proud to shout in the whole world, that she was gang raped unless she not looking for justice. If Nicole is reallly after money, is there anyone out there who can prove that she got paid? Is she a multi-millionaire now? I dont think so, she is just another ordinary victim who really don’t know what her future will be.

    Let’s just say that it wasn’t an American who raped Nicole. Let’s say it was the former Congressman Jalosjos. I am very positive that all of you will be happy to crucify Jalosjos for raping Nicole. Why? because Jalosjos is a Filipino. Who cares about him? He’s just a fair skin Filipino. He doesn’t have a blue or green eyes, doesn’t have a pointed nose, doesn’t have an accent. But Smith has everything, looks, appeal, accent. I am sure if Smith will have a chance to get out of his jail cell, a lot of offer will be tendered to him by movie outfit in the Philippines. He has the looks to become a movie star. I guess Philippines is that so cheap eh?

    hi i just wanna ask or i just want to say my opinion on this case…is nicole really drunk? coz i think in the word pasuray2x seems she still know what she is doing because if we will say na tottaly drunk dapat she already dont know how to walk db? i mean yeah let say she is drunk but it doesn’t mean she is not in her pressence of mine, she still have it but the fact is she does not control the alcohol inside her body…pero alam pa niya ang ginagawa niya! it doesn’t mean guys na may kinakampihan ako..i’m just curious with the word pasuray2x kc…..

    Reading through all of the information that was put up here a few years ago makes me wonder about a few thinks. If her BAC was really 449.9 how was she doing anything except laying on the floor or the ground? When was her blood drawn for a BAC test and what were the results? Never saw this information anywhere, possibly because she never had a BAC done in a timely manner. I bring this up because of the chart that was used showing her BAC at different times of the night and future down the page there is a listing of the BAC levels and effects. The one that stands out the most is “400-500 = Unconscious. Deep coma. Death from respiratory depression” If she was that drunk how was she able to scream once she was dropped on the side of the road?

    i was saddened by her story and pitied her and was so enraged with this daniel smith guy months and moths past but

    now i think nicole’s a materialistic, stupid, pathetic girl who just thirsts for attention (wow, combs her hair while walking past cameras.woot woot cameras everywhere, talk of the town/country).

    binale-wala niya ang efforts ng mga tumulong at tumutulong sa kaniya. what about the medical findings, yung alcohol level, yung bruises sa internal genitalia niya..and all that stuff..wasted by backing away from the case. naisip ko tuloy:

    baka wala siyang bilib sa sistema dito sa Pilipinas, walang bilib sa mga Pilipinong experto na naglaan ng oras at panahon para matutukang maige yung kaso niya.

    naisip niya siguro na di kapani-paniwala ang mga findings nila (kasi nababayaran din sila tulad ng halos lahat ng ahensya ng gobyerno), ganun ba yun?

    o baka naman habol lang talaga niya ang ‘american dream’.

    dumagdag pa sa kakairitahan mo dito kay nicole ay pinapakita niya kung pa’no siya mag-isip:

    the most irritating of all is the fact that she’s going to the states. i mean, seriously??? even my ten year old sister feels something is wrong with the way she thinks, reflecting the majority of how filipinos think of what a good life is.

    ok na sana na tumiwalag siya e, pero ang pagpunta niya sa abroad ay nangangahulugan ng pagtakas–it gives off a notion to us audiences of this telenovela-ish story that indeed, may nangyari beyond our knowledge. nicole disappoints us. nasayang ang chance ng Philippine government na ipakita ang kahusayan nito, but this time,dun sa tamang paraan na, finally.

    argh. i know that the points i have cited don’t seem to be cohesive, after all i am not a learned lawyer, doctor, wtvr..but the thing is, i am alarmed. as a youth, i am really concerned with this matter.

    as well as enraged with this nicole girl.
